RECORD OF PROCEEDINGS RELATING TO THE HOWELL FREE PUBLIC LIBRARY AND CARNEGIE LIBRARY BUILDINGcontinuation (contract)
and accepted by the said party of the first part.
Provided: That no money shall be due under the contract until two thousand dollars ($2000) worth of work and materials shall have been completed and accepted
by the said architect and approved by the said party of the first part when seventeen hundred dollars shall be paid said party of the first part and no further money shall be due until
two thousand dillars($2000) worth more of work and material shall have been completed and accepted by said architect and approved by said party of the first part when seventeen
hundred dollars more will be paid said party of the first part and no further money shall be due until two thousand follars ($2000) more work and materials shall have been completed
when seventeen hundred dollars more will be paid said party of the first part and no further money shall be due until the entire building is completed and accepted when the balance of said nine thousand
seven hundred and twenty five dollars ($9725) shall be due and payable subject to the proposition of Andrew Carnegie of January 9th, 1902 and the letters of the Home Trust Company
of August 4th and 11th, 1902.
6. It is further agreed by and between the party of the first part and second party that the schedules made and submitted by the said party of the second part, and attached hereto, shall no be
construed as a part of this contract, but only as a base upon which estimates are to be prepared but the party of the second part shall be held responsible for the performance of all work
and all materials necessary to fully and entirely complete the entire building in accordance with the aforesaid plans, specifications of the architect to the entire satisfaction and
acceptance by the said party of the first part, although such a schedule may omit either work or materials or both.
7. It is further agreed and understood by and between the parties to this contract, that no claim for extra work or materials, furnished or alleged to be furnished by the said party of the second
part on account of the construction of said Library Building shall be allowed by the said party of the first part, unless the same shall have been
previously ordered by them in writing in the same form and manner as this contract has been executed and the costs of the same agreed upon, and accepted in writing by the party of the
second part before the same shall be in force and effect.
8. the said party of the second part further agrees as aforesaid to commence work upon the material for the construction of the aforesaid building within ten days fromthe date hereof and
to have the entire building fully and entirely completed and ready for delivery and...
