RECORD OF PROCEEDINGS RELATING TO THE HOWELL FREE PUBLIC LIBRARY AND CARNEGIE LIBRARY BUILDINGContinuation of Contract
acceptance on or before the first day of January A.D. 1904, the construction to commence in the spring of 1903 as early as the weather permits.
9. The said party of the first part is hereby required to furnish and deliver unto the said party of the second part within three days from the date hereof a full
set of blue prints plans of said building and copies of specifications.
10. The said party of the second part is hereby required to and shall furnish and deliver unto the said party of the first part, a satisfactory bond with two
sureties in the sum of nine thousand eight hundred dollars ($9800) conditioned to guarantee that the said party of the second part shall carry out and fulfill all the
obligations of this contract and those set forth in the plans and specifications to the full and entire satisfaction of the party of the first part, and
also conditioned to save the said party of the first part harmless from mechanics, builders or material mens liens.
11. Should the party of the second part at any time during the progress of said work refuse or neglect to supply any necessary material or workmen then, and in
such case the said party of the first part shall have the right and power to provide material and workmen (after three days notice) to finish said work and the expense
shall be deducted from the amount of said contract price.
12. Should the said party of the second part fail to complete the said building at the time above agreed upon, then in such case (unless an extension
of time is granted by the party of the first part in writing) the party of the second part shall pay the said party of the first part as liquidated damages for nonperformance
of contract and not as a penalty or otherwise the sum of fifteen dollars for each and every day from and after the day above specified, during
which said building shall remain unfinished and not completed and delivered as aforesaid and which said party of the first part shall have the
right to deduct from and retain out of the sum hereinbefore agreed upon to be paid by the said party of the first part.
13. It is mutually covenented and agreed between the parties hereto that the heating apparatus in said building shall be completed, ready for
operation on October 1st, 1903, and said building shall be heated thereby during the months of October, November, and December 1903, the
said party of the first part to furnish coal therefore.
14. It is mutually understood and agreed that the grade of said lot shall be raised two feet and nine inches from the present grade at the southeast corner of said lot.
15. The party of the first part is to have the right to put on lights in said building and turn electric current on before the acceptance of said bulding.
All the covenants and agreements herein made are declared binding on each of the parties, hereto, and on their resepctive heirs, respresentative
or assignees.
