RECORD OF PROCEEDINGS RELATING TO THE HOWELL FREE PUBLIC LIBRARY AND CARNEGIE LIBRARY BUILDINGcontinued
the west fifty feet in width of the south eighteen feet of lot (88) eighty-eight, and the east fifty feet in width of the south eighteen feet of lot ninety-one
(91). All in Crane and Brooks plat of the said village of Howell as duly laid out, plated and recorded and to be located thereon as said party of the
first part shall hereafter designate, a Library Building, of the forms, sizes, and dimensions, and according to the plans, specifications, detail and
working drawings furnished by E.E. Myers and Charles W. Koehler, architects of the City of Detroit, in the state of Michigan, and numbered from
one to eleven both inclusive all of said plans, specifications and detail drawings, and builders schedule, together with the general instructions, have been
signed by the party of the first part aforesaid, and by the said party of the second part, and are hereby made and accepted as a part of this contract,
the same in all respects as though each and every part thereof was at length herein set forth and fully described and all of which are now on file in the office
of the party of the first part.
3. And the said party of the second part doth hereby covenant, promise and agree for the consideration aforesaid to do all the work and labor and to furnish
all the materials at his own proper costs, charge and expense, which may be requisite and required for the full and entire erection, construction,
and completion of the said Library Building according to the plans, specifications and detailed drawings, aforesaid.
4. It is hereby further agreed between the parties hereto that E.E. Myers, architect of the city of Detroit and state of Michigan shall be and is hereby appointed
and constituted the supervising architect of said building in and about and during its construction, and he is hereby authorized and empowered
to inspect and accept or reject any work done or materials used or proposed to be used in, upon, or about the said building during tis construction, that is,
if not in accordance with the plans and specifications.
5 In consideration only of the true and faithful performance of the covenants and agreements herein before and hereinafter specified, by the said party of the
second part, and in the manner and within the time hereinbefore set forth, .then the said party of the first part hereby covenants promises, and agrees to and will pay
to the said party of the second part the sum of nine thousand seven hundred and twenty-five dollars ($9725) in the manner following, that is to say: In payments as the
furnishing of materials, and work construction of aforesaid building shall progress, on estimates to be made by the supervising architect and
allowed by the party of the first part, for materials so delivered and accepted and work satisfactorily done by the said party of the second part.
Such payments however, to be only eighty-five percent of the amount of such estimates and the remaining fifteen percentum to be paid on the final
estimate of said supervising architect to be made when the said Library building shall be entirely completed.
